Messaging and Acceptable Use Policy

Rules for calling, SMS, MMS, and related communications sent through or connected to Zapity.

Purpose

This policy applies to calling, SMS, MMS, automated follow-up, review requests, and related communications sent through or connected to Zapity. It exists to protect recipients, maintain service quality, and comply with carrier and legal requirements.

Permitted Use

Zapity permits legitimate business communications such as:

Consent

Customers must obtain and document appropriate consent before sending messages. Requirements vary by message type, jurisdiction, and use case. A customer-initiated conversation, a request for follow-up, a transactional communication, and a promotional communication may each carry different consent obligations.

Identification

Messages must identify the business clearly when the recipient may not reasonably know who is contacting them.

Opt-Out Handling

Customers must honor recognized opt-out requests, including STOP, END, CANCEL, UNSUBSCRIBE, and QUIT. Recipients who opt out must not receive additional non-required messages unless they later provide valid consent again. HELP responses should be provided where applicable.

Business Identity and Registration

Zapity may require customers to provide accurate legal owner name, legal business name, trade name, entity type, EIN or other permitted identity information, business address, website, contact information, consent process, sample messages, and messaging use case. This information may be submitted to communications providers, carriers, registration authorities, or compliance vendors when required.

Reasonable Use

Services represented as included or unlimited remain subject to reasonable person-to-person business use, provider rules, technical limits, and abuse prevention.

Monitoring and Enforcement

Zapity may monitor usage patterns and complaint rates, investigate suspected abuse, request supporting consent records, limit sending, suspend messaging, suspend an account, terminate service, and cooperate with providers and lawful authorities. Zapity may pass through carrier penalties caused by customer violations where permitted by the customer agreement.

MMS and Attachments

Customers must have the right to send any image or attachment and must not send unlawful, infringing, harmful, or sensitive content in violation of applicable rules.

Call Recording

Customers must determine whether recording is permitted and provide all required notices and obtain all required consent.
